Public law

The Public law department at DELSOL Avocats provides advisory and litigation services, particularly before administrative courts, on behalf of:

• public and quasi-public entities: the State, regions, departments, municipalities, public intermunicipal cooperation agencies, hospitals, semi-public companies, and public institutions,
• their service providers and partners: private actors in the real estate sector (investors, developers, public project owners, project managers, construction companies, etc.), engineering firms, public service concessionaires, industrial groups, associations, etc.

It provides them with the technical and operational expertise essential for project development, the financing and management of public infrastructure, the organization of public activities and services, as well as team management.

To this end, it draws on expertise in the following areas:

• Public property and procurement law: public procurement, public service delegation, partnership agreements—particularly public-private partnerships, administrative and hospital long-term leases, and agreements for the use of public property,
• Civil service law: staff transfers (transfer back to in-house, outsourcing), mobility of civil servants, functional employment, disciplinary sanctions, functional protection, tenure procedures, dismissal of contract employees, summary proceedings for expert opinions, summary proceedings for suspension,
• Regulatory, operational, and individual urban planning law; land use planning law (Urban Development Partnership Agreements (“PUP”), Concerted Development Zones (“ZAC”) and land subdivisions),
• Environmental and Energy Law: facilities classified for environmental protection, fossil fuels, nuclear energy, and renewable energy,
• Local government law: real estate management (public property), personnel management (civil service), institutional relations (restructuring, intermunicipal cooperation), contract engineering (analysis and selection of legal structures and partners), procurement (public procurement), organization and oversight of their activities (public services, police, etc.),
• Structuring of public, private, and mixed-use real estate projects: project development, land acquisition and management, selection of contractors, consideration of environmental constraints, and monitoring of construction through to delivery to the end client.
